1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information we collect may include:

  • names
  • phone numbers
  • email addresses
  • mailing addresses

Sensitive Information. We do not process sensitive information.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies, pixels, and similar technologies — including advertising pixels used to deliver relevant ads to you on other websites and platforms.

The information we collect includes:

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, including your IP address, device information, browser type, activity on the Services (pages viewed, searches, features used), and device event information such as system activity and error reports.
  • Device Data. Information about the computer, phone, tablet, or other device you use to access the Services, which may include your IP address, device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. Information about your device’s location, which can be either precise or imprecise, depending on the type and settings of the device you use to access the Services. You can opt out of allowing us to collect this information by refusing access to the information or disabling your device’s location setting. If you opt out, you may not be able to use certain aspects of the Services.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, deliver relevant advertising, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To deliver and facilitate delivery of services to you. We may process your information to provide you with the requested service.
  • To respond to your inquiries and offer support. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time — see WHAT ARE YOUR PRIVACY RIGHTS? below.
  • To deliver targeted advertising to you. We work with advertising partners (such as Meta and Google) who use cookies, pixels, and similar technologies to help us develop and display advertising tailored to your interests, based on your activity on our Services and elsewhere online. See WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION? for more detail, and WHAT ARE YOUR PRIVACY RIGHTS? for how to opt out.
  • To administer prize draws and competitions. We may process your information to administer prize draws and competitions.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so — such as your consent, to comply with the law, to fulfill a contractual obligation, to protect your rights, or to pursue our legitimate business interests.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (express consent) to use your personal information for a specific purpose, or in situations where your permission can reasonably be inferred (implied consent). You can withdraw your consent at any time.

In limited cases, we may be permitted under applicable law to process your information without your consent — for example, to investigate fraud, respond to a legal process such as a subpoena or court order, or as otherwise required or permitted by Canadian privacy law.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in the situations described below, and with the third parties listed here. We do not sell your personal information for money.

We may need to share your personal information in the following situations:

  • Advertising Partners. We share limited information — such as device and browsing data collected through cookies and pixels — with advertising partners like Meta and Google so they can help us deliver ads that are relevant to your interests, both on our Services and elsewhere online. We do not sell your personal information to these partners for money, but this kind of sharing may be considered a “sale” or “share” under some state privacy laws, which is why we’ve called it out separately here. You can opt out of this at any time — see WHAT ARE YOUR PRIVACY RIGHTS?.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Google Maps Platform APIs. If you use a dealer- or store-locator feature on our Services, we may share your information with Google Maps Platform APIs and cache your location on your device. You may revoke your consent at any time by contacting us using the details at the end of this document.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use cookies, pixels, and similar tracking technologies to operate our Services and to deliver relevant advertising.

We use cookies and similar tracking technologies (like web beacons, pixels, and tags from advertising partners such as Meta and Google) to operate the Services, understand how visitors use them, and deliver relevant advertising. You can control cookies through your browser settings — see Section 10 below for more on browser-level controls.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice, unless a longer period is required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if that isn’t possible (for example, because it’s stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented reasonable technical and organizational security measures designed to protect the personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise that hackers, cybercriminals, or other unauthorized parties will never defeat our security. Transmission of personal information to and from our Services is at your own risk, and we recommend you only access the Services within a secure environment.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor’s use of the Services. If we learn that we’ve collected personal information from a user under 18, we will deactivate the account and take reasonable steps to promptly delete that data. If you become aware of any data we may have collected from a child under 18, please contact us at alum.products@merrittproducts.com.

9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as Canada and Colorado, you have rights that give you greater access to and control over your personal information.

Depending on where you’re located, you may have the right to: (i) request access to and a copy of your personal information; (ii) request correction or deletion; (iii) restrict how we process your personal information; (iv) request data portability; and (v) not be subject to automated decision-making. You may also have the right to object to certain processing. To make a request, use the contact details in HOW CAN YOU CONTACT US ABOUT THIS NOTICE? below.

Withdrawing your consent. If we’re relying on your consent to process your information, you can withdraw it at any time using the contact details below. This won’t affect the lawfulness of processing that already happened before you withdrew consent.

Opting out of marketing, promotional, and targeted-advertising communications. You can unsubscribe from marketing emails at any time by clicking “unsubscribe” in the email, or by contacting us. You can opt out of targeted advertising by contacting us directly, or by using your browser or device’s ad-preference and cookie controls. We may still send you non-marketing, service-related messages (such as order or shipping updates).

Cookies and similar technologies. Most browsers accept cookies by default. You can usually set your browser to remove or reject cookies — doing so may affect certain features of our Services.

If you have questions about your privacy rights, email us at alum.products@merrittproducts.com.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature you can enable to signal that you don’t want your online activity tracked. Because no uniform technical standard for DNT signals currently exists, we do not respond to DNT signals at this time. If a standard is adopted that we’re required to follow, we’ll update this notice accordingly.
